New information in the Clover Ave. murder case in Odessa has been revealed

A witness told Odessa Police that Carlos Ruben Cruz felt John Adauto's pockets for drugs, said obscenities and proceeded to shoot and eventually kill him.

ODESSA, Texas — In an affidavit obtained by NewsWest 9 explained what happened on Nov. 28 when a murder occurred in Odessa in the 4300 block of Clover Ave.

Court documents say an officer was dispatched to a residence on Clover Ave. and found 38-year-old John Michael Adauto suffering from a gunshot injury.

Then the officer saw 57-year-old Carlos Ruben Cruz walking out from the hallway/kitchen area of the residence with a black firearm. The officer told Cruz to put the gun down and then proceeded to do so. Cruz was then put into handcuffs.

Medical staff arrived to the residence and pronounced John Adauto deceased.

John Adauto's sister-in-law witnessed the altercation and said she was there to pick up John Adauto from his uncle's house and heard arguing.

The sister-in-law told Odessa Police that Cruz searched John Adauto's pockets for drugs, said obscenities and proceeded to shoot him in the face.

The witness described Cruz, who was taken off in handcuffs, as the murder suspect.

Cruz was arrested and charged with murder and theft of firearm due to the fact that the weapon he used was stolen out of the Monahans Police Department.
