Odessan charged with murder after selling pills containing Fentanyl to 16-year-old

18-year-old Nathaniel Martinez sold pills containing Fentanyl to a teenager on Oct. 2. That teen later died from fentanyl poisoning.

ODESSA, Texas — A teen died due to Fentanyl poisoning on Oct. 2.

As of Friday, the man who allegedly sold him the pills he overdosed on has been charged with murder manufacturing/ delivery of a controlled substance causing death.

According to an arrest affidavit, on Oct. 2 at about 7:19 a.m., OPD responded to an overdose call. Odessa Fire Rescue also responded to the residence and located an unresponsive juvenile identified as 16-year-old Damien Aguilar, who was transported to MCH for treatment.

Witnesses stated that Aguilar had overdosed on Fentanyl in the past. When a witness went to wake him up for school on that day, he was sitting on the floor in his room. they asked Aguilar if he was okay and he said he wasn't. When the witness tried to get him up, Aguilar lost consciousness. The witness administered Narcan to him and began giving CPR.

A witness believed Aguilar had overdosed on suspected counterfeit blue M30 pills, which are known to contain Fentanyl. because they had seen him take them in the past.

The residence was searched and eight of those pills were located in his room.

Aguilar was life-flighted from MCH to a medical facility in Lubbock County where he was pronounced braindead on Oct. 2.

The next day, Aguilar died. An autopsy performed on Oct. 5 by the Lubbock County Medical Examiner and the forensic pathologist stated the suspected cause of death was Fentanyl poisoning.

Officers located an Instagram account for Aguilar. A search warrant was obtained on Oct. 4 for the account.

The communication records indicated that the individual Aguilar was purchasing these pills through was using the account name: "nate.frm432". The records further indicated the pills Aguilar purchased just hours before the poisoning were purchased from the account. The address he purchased them at was listed as well. It was also confirmed on geolocation tracking data that Aguilar had gone to that address.

This all indicated he had not been in possession of any suspected pills prior to purchasing them from the account on Oct. 1, and that he had not arranged to purchase the pills from any other individuals just prior to the poisoning.

On Oct. 27 at about 5 p.m., OPD responded to a separate incident that put 18-year-old Nathaniel Martinez in MCH.

While he was there, Martinez was found with about 21.2 grams of suspected counterfeit blue M30 pills suspected of containing Fentanyl, and a warrant for Martinez's arrest was obtained for manufacturing/ delivering a controlled substance.

After he was discharged from the hospital that same day, he was arrested and taken into custody.

Martinez was taken to the OPD and spoke with a detective. he said his address was the same address that Aguilar got the pills from, and he has lived there for the past two months. He also stated he was the user of the Instagram account "nate.frm432". He also stated that he deals about 200 to 300 M30 Fentanyl pills each day and that he sold pills to Aguilar.

He also admitted to knowing that people overdose frequently and can die from using the pills and that he had personally witnessed about five or six separate non-fatal overdoses as a result.

Martinez sits in the Ector County Jail where he faces this murder charge and delivery of a controlled substance, sitting at a combined bond of $100,000.
