Arrest affidavit reveals more details into homicide in Odessa

On May 18, 37-year-old Jacob Daily was reportedly highly intoxicated when being interviewed by Odessa PD, telling officers that Adam Beltran committed suicide.

ODESSA, Texas — NewsWest 9 has obtained an arrest affidavit for 37-year-old Jacob Daily who has be charged with the murder of a man named Adam Beltran. The affidavit reveals why the Odessa Police Department's investigation into the incident turned from a suicide case to a homicide case.

On Saturday, May 18, at approximately 3:47 p.m., the Odessa Police Department responded to a medical call in the 3100 block of North Dixie Blvd.

According to the affidavit, when officers arrived, they found a man, later identified as Beltran, laying in the front passenger seat of a Volkswagon car with a gunshot wound to the head. Beltran was pronounced dead at the scene. Also, OPD found a gun on the rear bumper of a Ford F-150 that was parked near the Volkswagon.

The affidavit stated that OPD made contact with Daily and two others at the scene. During interviews with the three, it was discovered that Daily was outside when the shooting occurred and was with Beltran all day. When officers spoke with Daily, who was reportedly highly intoxicated at the time, he said that Beltran shot himself.

According to the affidavit, a witness removed the gun, a Sig Sauer pistol, from Beltran's left hand and placed it on the rear bumper of the Ford F-150.

Daily stated to police that he saw Beltran shoot himself and ran inside the residence on North Dixie, yelling for help. Daily also said that he was inside the residence when the shooting occurred.

According to the affidavit, OPD found these stories conflicting.

During an investigation by OPD, while searching the residence, officers found multiple 9mm ammunition that was inside Daily's backpack. A witness told police that Daily was outside the residence carrying a backpack when she heard a gunshot. The affidavit states that OPD found the backpack inside the residence on top of Daily's bed next to a black Keltic KSG three-barrel shotgun.

On Wednesday, May 22, Daily was brought into the Odessa Police Department station. He then openly told police that he assaulted Beltran and shot and killed him. Daily has been arrested for murder and unlawfully carrying a firearm.

Pertaining to Beltran's alleged murder, next of kin was notified.
