LEA COUNTY, N.M. — New Mexico State Police are reporting a Tennessee man is dead following a crash on State Road 18.

According to police, the crash took place around 5 a.m. on January 27 near milepost 6.

Investigators say an SUV driven by Gary Marshall, 63, of Mulberry Tennessee tried to pass a tractor-trailer that had slowed down to make a left turn by using the northbound lanes.

However, the SUV sideswiped the larger vehicle and rolled.

Police say Marshall was ejected from the SUV. He was taken to an area hospital where he later died.

NMSP also say seat belts do not appear to have been properly worn at the time of the crash.

The crash is still under investigation and no further information is available.
