An Ector County man on death row will get a new sentencing trial.
Michael Dean Gonzales' death penalty sentence has been thrown out, because an expert witness testified Gonzales' ethnicity made him a future threat to society.
Gonzales is Hispanic.
He was convicted in the 1994 murder of Manuel Aguirre and his wife, Merced, during a break-in at their Odessa home.
Jury selection in the Gonzales case will begin in April.
