PECOS - A convicted sex offender is getting closer to trial for a double murder in Pecos, but first he has to go to federal court.

Before 50-year-old Randall Lee Stephens can be tried for captial murder, he'll have to go to federal court for failing to register as a sex offender.

That court date is set for January 13th.

Reeves County District Attorney Randy Reynolds tells us he can move forward with the murder trial once the federal case is prosecuted.

Police say Stephens went on the run after murdering Rick and Alicia Cherry at their bar in Pecos called DJ's Roundup back on May 6th.

Alabama Police nabbed Stephens at a truck stop on I-20 almost a month later.
