Court Rules on OPD Benevolence Fund

A benevolence fund set up for the families of three slain Odessa Police officers will be divided equally.

ODESSA - A benevolence fund set up for the families of three slain Odessa Police officers will be divided equally.

That was decided this morning by Judge Stacey Trotter. Trotter decided in a hearing that the $492,752.08 that has been raised by the community will be divided three ways.

Abel Marquez's portion will go into a trust fund for his two children. Scott Gardner's portion will be given to family members. Details about Arlie Jones' portion of the fund are still being worked out by the family. In the meantime, a district court will keep track of the money.

Marquez, Gardner and Jones were killed while responding to a domestic dispute in September of 2007. Questions about how to divide the benevolence fund surfaced because all three officers did not have wills.
