MIDLAND - Midland County will have to try again to get a conviction in a manslaughter case from 2007.

Jurors couldn't reach a verdict in the case against 31-year-old Dan Frank Mull.

Mull was charged in connection with the crash that killed his passenger, 29-year old Lisa Rupe back in January of last year.

According to investigators, rain slicked roads and reckless driving were the reasons Mull slammed his car into a utility pole.

We're told Rupe took the brunt of that impact.

Jurors deliberated for a little less than an hour before informing the judge they couldn't reach a unanimous decision on Mull's guilt or innocence.

No word on when that new trial will be.
