ODESSA - Jesse Alvarez, the 5-year-old boy from Odessa who died in California on the 4th of July was laid to rest on Friday.

Earlier this week, Jesse's mother signed his body over to his father so he could be buried in Odessa.

A family member tells NewsWest Nine "I think we have prolonged this enough and we are just happy he is finally home and can be laid to rest."

Jesse died while playing on the beach with his mother's boyfriend, 24-year-old Juan Nunez.

Investigators say Jesse stopped breathing when Nunez put sand in his face.

Nunez has been charged with involuntary manslaughter and child endangerment.

He made his first appearance in court earlier this week, and pleaded not guilty to the charges.

Nunez remains in jail in lieu of one million dollar bond.
