An Odessa father is mourning the loss of his son after he died on a California beach.

5-year-old Jesse Alvares, was in California with his mother, celebrating the 4th of July, when it happened. Now his mother's boyfriend is being charged in the child's death.

Chris Alvarez, the father of Jesse Alvares, called NewsWest9 asking for help. He wants answers in his son's death.

California authorities tell NewsWest9 that 24-year-old Juan Nunez was arrested in the child's death. He is charged with Assault Resulting in the Death of a Child.

Nunez was with Jesse and his mother on the beach when the boy died. Deputies say Nunez put sand on Jesse's face which caused him to stop breathing.

Nunez is being held in the San Luis Obispo County Jail on a one million dollar bond. This isn't the first time Nunez has been in trouble with the law. He is currently on parole. Because of that, the District Attorney's Office is trying to file additional charges against him.
