A court date has been set for former Midland City Councilman Bill Dingus to settle any questions about his eligibility.

Dingus filed to run against Incumbent and House Speaker Tom Craddick back in December.

At the time, he did not resign his At-Large seat on the City Council.

Later, the Republican Party of tTxas challenged his eligibility.

The Texas Democratic Party responded by taking it to court.

A judge ruled Dingus was ineligible to run, because he didn't leave the City Council first.

However, his name was left on the ballot.

A few days later, Dingus then resigned from City Council.

Now he's asking a judge to clear up any issues about his run for the seat.

That court date is set for Monday.
