SAN ANGELO - Child welfare authorities plan to appeal a ruling in the polygamist sect case, arguing the State was right to put more than 440 children in foster care.

The State is also asking the Texas Supreme Court to allow it to keep custody of the children until the appeal is settled.

This comes one day after the an Appeals Court in Austin ruled the State failed to prove the children at the Eldorado ranch were in any immediate danger.

Members of the polygamist church claim there was no abuse at the compound in West Texas and they're being persecuted for their religious beliefs.
