MIDLAND - Midland's City Council had one vacant chair at their meeting Tuesday morning.

NewsWest Nine spoke with Mayor Wes Perry Tuesday morning who says the Council will meet within the next few days to decide when to hold an election.

They plan to post the job opening and move forward as soon as possible.

Initially, Dingus says he went by one 1996 law which said he could run for State Representative while being on the City Council, but other Texas laws say you can't do both at the same time.

Dingus plans to take legal action to insure he can stay on the ballot to give voters a choice in the election.

He plans to run for the District 82 seat currently held by Speaker Tom Craddick.
