The battle over whether Bill Dingus can run for State Representative heats up.
The State Democratic Party is asking a judge to settle a dispute with Republicans on whether the former City Councilman can run for the office.
It all started when the Republican Party of Texas sent a letter to the Democratic Party this week, suggesting Dingus could not challenge Tom Craddick, because he didn't resign from the City Council before filing to run for Craddick's seat.
The Democrats claim a Federal Court ruling says a Council member can announce candidacy for any office, and is considered to have automatically resigned from a local position if sworn in to that other office.
Craddick's Office claims the Speaker had nothing to the do with the letter sent to the Democratic Party.
