A former Midland Academy Charter teacher sentenced to prison for sexually assault has been denied a new trial.
Now the case for David Van Houten heads to a State appeals court.
On Monday, Judge Robin Darr in Midland denied Van Houten's motion for a new trial.
His attorney's claim the case wasn't properly litigated.
A local jury found the former eighth grade social studies teacher, guilty of molesting one of his 14 year old female students.
The judge sentenced Van Houten to 26 years in prison, back in July.
