Police were called to Madison Park Apartments on March 10, 2017 for a welfare check around 11 p.m. and found a neighbor holding a small child. The neighbor said the child was naked without a diaper and sitting outside of an apartment crying.

The child was alone and did not have adult supervision.

The neighbor told police the front door was open so they went in to get the child some clothing.

When police went inside the house, the officer smelled marijuana and found a marijuana pipe on a TV stand, within the child's reach, according to the police report. CPS was called and the child's mother left work to get the child.

The man who was supposed to be watching the child, 27-year-old Nickolas Roy Perez, later arrived and told police he was watching the child when his brother pulled up. He went outside to talk to him, then got into the vehicle to run errands since he just got paid. He told police he forgot about the child, but later remembered he left the child alone and went back to the house where the child was left. He told police the marijuana pipe was his, according to the report.

He was arrested and charged with abandoning or endangering a child and possession of drug paraphernalia. He was released on bond from the jail before he was indicted on the charge of abandoning or endangering a child.
