DPS releases report regarding toddler found hours after an accident

ODESSA, TX (KWES) -

State troopers released the crash report on an accident that left a four year old girl paralyzed.

We're learning the toddler's legal name is Daniela Armendariz.

The report says she not wearing a seat belt but it's unclear if she was actually in the back seat.

The driver, Ever Ortega, was given a blood test for alcohol.

The toddler was found behind the driver's seat in the SUV by a tow trucker hours later.

Odessa fire rescue says they asked Ortega several times if anyone else was in the SUV and they were told no.

They also say the SUV had heavy damage in the back where they couldn't open to the doors easily, but did look in the windows and didn't see the little girl.

DPS is investigating to see if proper procedures were followed.
