ODESSA, TX (KWES) -

Kimberly Ann Nieto, 26, is accused of slapping her grandmother, Teresa Renteria, 64, on the 1400 block of Alleghaney Avenue after they got into a domestic dispute. She then fired shots at her and took her 9-year-old child to her cousin's house on 800 block of Fall Avenue.

A relative inside the house says he didn't know what was going on until he woke up and looked outside his window. That's when he said he saw the swat team calling for his cousin to surrender.

"I told her, 'What did you do? The swat team isn't here for nothing,'" said the relative.

The homeowner wanted to remain anonymous. His cousin, Nieto, had only been staying with him for a few days.

"The house was all surrounded. I got up to go use the restroom when I heard them calling her out. She was telling us to not make any noise. I said, 'They know that you're here.' I said, 'I'm going to go outside and tell them who's in there,'" said the relative.

There were a total of seven people in the house, including Nieto's three young children.

The homeowner says Nieto had been having issues with her great grandmother for a while.

"They've been having problems with her for a long time. It is because of the kids. She doesn't take them to school," said the relative.

"It's important to note this was an isolated incident. This was domestic related," Cpl. Steve LeSueur of the Odessa Police Department.

Nieto's cousin says he never thought anything like this would happen, especially at his own home.

"I still love her and everything," said the relative. "I never would have expected her to do something like that."

Nieto surrendered peacefully after nearly three hours. She was charged with aggravated assault with a deadly weapon. She could be facing up to 20 years in prison.

Police say at this time there are no additional charges, but the investigation is ongoing. Renteria suffered minor injuries.
