Odessa Man Accused of Assault, Injury to a Child

ODESSA, TX (KWES) -

An Odessa man is behind bars following an incident in Odessa.

Odessa Police were called out to Rabb Court in reference to a domestic disturbance.

When officers arrived, they began talking with David Wayne Smith, Jr., 44, of Odessa.

Police say as they were talking with Smith, he became uncooperative and refused to speak with officers about the incident.

According to the report, Smith’s wife told police that her husband came home drunk with a large beer and she tried to throw the beer away.

That’s when, police say, Smith grabbed his wife by the throat and pushed her against a wall. Smith’s wife also told police that her husband pushed on her throat, causing her to lose the ability to breathe normally.

Authorities say as Smith was assaulting his wife, their 5-year-old son attempted to get Smith off his wife but police say Smith pushed his son to the ground, causing bodily injury.

Smith was later arrested and charged with assault by strangulation and injury to a child.
