“It's all or nothing.” That's the statement all of the Justice of Peace officials in Ector County have received from County Attorney Dusty Gallivan about same sex marriages.
Gallivan added that while Justice of the Peace officials are not required to perform marriages, they’re also not allowed to discriminate against the couples.
Any official who refuses to hand out licenses for same sex couples could end up getting sued and becoming a liability for the county.
Gallivan also addressed the issue of county clerks refusing to issue marriage licenses for religious reasons saying that they are legally bound to perform the duty despite any objections.
