Noise Complaints Regarding Local Business Aren't Being Heard

ODESSA - Imagine living feet away from an establishment that plays music 12 hours a day and 7 days a week and not being able to do anything about it. Well, that's what one Odessa resident is claiming that she has been dealing with for last eight months.

"This car wash has been a complete nuisance. You can see from my back door six speakers on top of the car wash and they play music from even before 8:00 a.m. in the morning until late at night," Rachel Moody said.

The president of the company did not want to comment on camera but he did state that they are within compliance of the Odessa City Ordinance and the legal decibel(dB) level. He also stated the reason why the business chooses to play their own music.

"I have spoken with on the owners and the reason is because they don't want cars to come into the car wash and blare their music while their cleaning out their cars," Moody said.

Apex Express Carwash says they do inform customers not to play loud music while at their establishment, which is why they choose to play their own music, but as a result, that has caused Rachel to call to police numerous times.

"I have actually spoken with the Odessa Prosecutor and because there's only been one police report filed, that is only one day that the prosecutor was concerned with. There's really not much the police can do because it's not at an illegal decibel level," Moody said.

The city ordinance in Odessa states that a loud speaker must not be operated between the hours of 10:00 p.m. and 12:00 midnight if the equipment is located within 150 feet of a residence.

Apex Express Carwash claims that they are located 162 feet from the nearest neighborhood and the business hours close at 8:00 p.m.

Even though Apex Express Carwash claims to be within the legal decibel level, it doesn't stop nearby neighbors from hearing the loud bass.

"That's all I hear is nothing but the bass, and like I was saying, I'm not all about the bass," Moody said.
