BIG SPRING – One man is in the hospital and is facing charges following an incident in Big Spring early Monday morning.
Big Spring Police tell NewsWest 9, they were called out to a burglary in progress in the 900 block of Birdwell just before 3 a.m.
While officers were responding, they learned that the suspect, 35-year-old Joe Luna, sitting on a porch with a firearm in his possession.
Upon further investigation, officers learned that Luna showed up to his ex-wife's home and was knocking on the door. The woman wasn't able to see who was knocking on the door and slightly opened the door.
That's when she saw who it was and tried to slam the door but Luna used his foot to stop her and pointed a rifle at her chest.
The woman stated that she grabbed the barrel with both hands and two fought when the rifle fired, hitting Luna in the leg.
The woman's son came to her aid and continued to fight until they got Luna outside and called police.
Police also said that the couple had been divorced for some time and that the woman had a protective order that later expired.
Luna was taken to the emergency room and was in surgery at last report.
The woman suffered minor injuries and her son was not injured.
After being released from the hospital, Luna will be facing charges of burglary of a habitation, possession of a firearm by a felon and possession of a prohibited weapon.
The investigation into the incident is ongoing.
