Man Accused of Shooting Deputy Was Wanted for Child Sexual Abuse

MIDLAND - 37-year-old Dan Higgins, or as most know him now as, the man suspected of shooting and killing Midland Deputy Mike Naylor, but that's not all he's accused of. 

Naylor and another deputy were serving an arrest warrant for Higgins when Naylor was gunned down. Higgins was wanted for aggravated sexual abuse of a child. 

According to documents, Higgins forced the young girl to perform oral sex on him and he also performed oral sex on her. The documents also say that Higgins tried to have sex with her. This all happened over the course of five years. 

Child Protective Services (CPS) and the Midland County Sheriff's Office made contact with the victim's mother. On October 8, just a day before the deadly shooting, they interviewed the young victim.

The girl told investigators that she had been sexually assaulted by Higgins more than 15 times and that it all started when she was just six years old. 

As it turns out, Higgins also has a criminal history. In August 2013, police were called out to the 3800 block of North County Road 1247 for a woman who had been acting hysterical. The report says that when officers approached her, it was obvious that she was on some sort of drug. Police then called her husband, Dan Higgins. 

When he arrived, police noticed he was also intoxicated on some sort of drug. His wife later admitted that she had used methamphetamine and other prescription drugs. 

Investigators went into the house and opened a safe. According to the report, they found several syringes and two small bottles that had meth inside of them. Both Higgins and his wife were arrested on drug charges. 

Now, Higgins is facing capital murder charges for the killing of Deputy Naylor. He's behind bars at the Midland County Jail. No bond has been set for him.
