ODESSA - An Odessa man set for execution is trying to see a judge.
Michael Dean Gonzales, also known as “Spider,” filed an application for Writ of Habeas Corpus last month.
That's when a prisoner asks to be brought before the court to determine if their imprisonment is lawful.
Gonzales stabbed his elderly neighbors to death back in 1994.
A judge set a date for his death but then ordered a stay of execution, which means it has been delayed.
Lawyers have asked for extra time to do more research and claim that Gonzales was not competent during his original trial.
