Felony Arrests by the Odessa Police Department - Sept. 11, 2014

36-Year-Old Higinio Garcia Jr.

Odessa Police arrested Garcia on 9-10-14 at approximately 0113 hours for Driving While Intoxicated 3rd or More, a Third Degree Felony. Officers responded to North West County Road and Kermit Highway in reference to a medical call. While officers were responding, dispatch advised the driver of a black Nissan appeared to be sleeping.

Upon arrival, officers observed a black 2010 Nissan Altima stopped in the 3000 block of Kermit Highway in the westbound lanes with its headlights off and brake lights on. Officers made contact with the driver, who was asleep behind the wheel, with the vehicle running and the gear in drive. Officers could smell a strong odor of an alcoholic beverage coming from the driver, who was identified as Garcia.

After Garcia refused field sobriety testing, he was placed into custody for driving while intoxicated. Dispatch advised Garcia had multiple prior convictions for driving while intoxicated, all out of Ector County. Based on the facts and circumstances presented during the investigation, Garcia was charged and arrested accordingly.

30-Year-Old Miriam Annette Hernandez

Odessa Police arrested Hernandez on 9-7-14 at approximately 2125 hours for Possession of Cocaine "State Jail Felony" and Public Intoxication "Class C Misdemeanor". Officers responded to the 5000 block of East 42nd Street in reference to a disturbance. Upon arrival, officers made contact with one of the involved parties, identified as Hernandez. Hernandez was placed into custody for public intoxication. While searching Hernandez, officers discovered cocaine inside her purse. Based on the facts and circumstances presented during the investigation, Hernandez was charged and arrested accordingly.

37-Year-old Fredy Edgardo Banegas

Odessa Police arrested Banegas for Driving While Intoxicated 3rd or More, a Third Degree Felony. Officers responded to the 600 block of Jeter in reference to a disturbance. Upon arrival, officers observed a maroon Ford F-150 attempting to flee from the residence. A traffic stop was conducted on the listed vehicle and the driver was identified as Banegas.

While making contact with Banegas, officers could smell a strong odor of an alcoholic beverage coming from his breath and person. Banegas was placed into custody after failing field sobriety testing. Further investigation revealed Banegas had multiple prior convictions for driving while intoxicated. Banegas was charged and arrested accordingly.

37-Year-Old Sigmund Demon Cook

Odessa Police arrested Cook on 9-10-14 at approximately 2041 hours for Criminal Non-Support "State Jail Felony", Driving While License Invalid with Prior Convictions "Class B Misdemeanor", and No Proof of Insurance with Prior Convictions "Class B Misdemeanor". Officers observed a white 2002 GMC Envoy traveling westbound in the 1600 block of West 22nd Street with a defective taillight. Further investigation revealed Cook had a felony warrant for criminal non-support. Based on the facts and circumstances presented during the investigation, Cook was charged and arrested accordingly.

28-Year-Old Stephanie Carrasco

Odessa Police arrested Carrasco on 9-10-14 at approximately 1948 hours at the Odessa Police Department. Officers arrested Carrasco for Theft "State Jail Felony", Theft "State Jail Felony", and Prostitution "Class B Misdemeanor". Investigation revealed Carrasco had three warrants out for her arrest, including two felony warrants out of Bexar County. Based on the facts and circumstances presented during the investigation, Carrasco was charged and arrested accordingly.

33-Year-Old Jeremy Fontain Majors

Odessa Police arrested Majors on 9-11-14 at approximately 0827 hours for Prohibited Substance in a Correctional Facility "3rd Degree Felony", Tampering with Physical Evidence "3rd Degree Felony", and Possession of Marijuana "Class B Misdemeanor". Officers observed a white 2003 Ford Explorer at 42nd and Andrews Highway displaying an expired inspection sticker. A traffic stop was conducted and the driver was identified as Majors.

Upon making contact with Majors, officers could smell a strong odor of marijuana coming out of the listed vehicle. As soon as Majors opened the driver door, officers observed a jar containing marijuana. While officers were searching the listed vehicle, they observed Majors reaching inside of his shorts and dropping something onto the ground. Officers then observed majors holding marijuana in his right hand.

As soon as officers attempted to retrieve the marijuana that Majors had dropped onto the ground, they observed more marijuana falling out of Majors' shorts. Officers also discovered a scale and a bag containing $4700. Majors was placed into custody for possession of marijuana and tampering with physical evidence.

Majors was arrested and transported to the ECLEC. While Majors was being searched at the jail, an Ector County Sheriff's deputy discovered more marijuana inside his shorts. Based on the facts and circumstances presented during the investigation, Majors was charged and arrested accordingly.
