MIDLAND - A man has been convicted of attacking a Midland deputy.
Elmo Fortenberry, Junior, has been sentenced to seven years in prison.
According to an affidavit, Fortenberry had called 911 to ask for advice on his rights.
When a deputy showed up, he began yelling profanities and that he wanted to talk with the sheriff.
That's when he began pushing and hitting the deputy.
The report says both fell to the ground and Fortenberry grabbed for the deputy's Taser.
The deputy was able to get him in handcuffs and said he could smell booze all over him.
