MIDLAND - A Kermit man is behind bars after being accused of assaulting a public servant.

Around 2 a.m. Saturday, Midland Police were dispatched to the 4500 block of Sinclair after reports of a man banging his head on the ground.

An officer found Brandon Stewart sitting on the sidewalk in an apartment parking lot.

Police say they could smell alcohol on Stewart so they placed him under arrest for public intoxication because he was a danger to himself.

But once in cuffs, Stewart refused to walk to the patrol unit.

So two officers tried to help him into the unit and that's when Stewart allegedly kicked the officer twice in the head.
