PECOS - A former Immigration and Customs Enforcement agent in Pecos, accused of selling speed, is trying to have one of his counts dismissed.
The attorney for Mark Carpenter filed motions to have the fact that he sold the drugs at a truck stop taken off of the record.
The lawyer claims the agents who busted carpenter set him up to enhance the charges.
Carpenter was being investigated after agents say he sold pills used to treat attention deficit hyperactivity disorder to federal agents twice.
They say he also bragged about using steroids and other stimulants and even told them how to get prescriptions for the drugs from a doctor.
The attorney also wants to have phone recordings and other statements suppressed from the case.
