ODESSA - Newly discovered evidence in the case of a murdered teenager is bringing closure to one Odessa family.

Another person has been indicted for murdering Evan Fitts, almost a year ago.

The new evidence was discovered last week and investigators secured an indictment to arrest 19 year-old Curtis Johnson.

They didn't have to look far for him.

We're told an investigator was eating at Logan's Roadhouse on Monday and spotted Johnson celebrating his 19th birthday.

Law enforcement moved in and arrested him.

He was formally charged for first degree felony murder.

His partner in crime, 19-year-old Trevor Atchinson, who is also facing a murder charge, is currently in the hospital.

We're told they're currently evaluating his mental capacity.

Shortly after the arrest back in 2012, Atchinson was deemed incompetent to stand trial.

According to court documents, in November of 2011, Evan Fitts was shot while the men were attempting to steal his truck.

The men drove through Sherwood Park and Fitts was shot in the back and thrown out of the moving vehicle.

Fitts died at the hospital.

NewsWest 9 spoke to Ector County District Attorney Bobby Bland about the new arrest.

"Hopefully this will bring at least the beginning of a sense of closure. Obviously the case is still pending, but they've lived over a year wondering who was the other person involved in their son's death," Bland said.
