Portales, New Mexico - An accused murderer out of Portales could be getting a re-trial.
42-year-old Arnoldo Navarette received a life sentence in 1993 for the shooting death of Reynaldo Ornealas, Senior.
But, the Supreme Court is reversing the decision after finding Navarette's rights were violated.
They say he wasn't allowed to confront the state pathologist who conducted the autopsy used as evidence.
Authorities say the Supreme Court has not yet formally issued their mandate, and unless the Judge says otherwise, the defendant will remain in custody pending his new trial.
