He was captured on Tuesday, found sleeping in his car at a truck stop, and on Thursday, "El Diablo" is scheduled to appear in court again.
Jacob Esparza will appear before a grand jury at his preliminary hearing.
He'll also have a detention hearing to see if he'll be given bond.
Esparza is accused of threatening to kill law enforcement officers, members of their families and detonate bombs.
Investigators say he used the online chat forum Topix to post threats against police in Fort Stockton and Midland.
A family member of Esparza called NewsWest 9 on Wednesday and said he had run-ins with the law before and may suffer from mental illness.
Homeland Security Investigations had been overseeing the hunt for him.
But in the end, it was the Pecos Police Department that spotted him and put him behind bars.
Early Tuesday morning, an officer spotted a vehicle that matched the description of the one given to them by HSI.
The vehicle was parked at the Flying J Truck Stop just down the street from the police department.
