HOBBS, N.M. - A police officer in Hobbs nearly had a wreck when a drunk guy almost side swiped him while changing lanes.

It happened a little before 2 a.m. Thursday morning.

The officer said he saw Arturo Montoya drive up on to the sidewalk while trying to make a U-turn.

He was driving on the shoulder when Montoya merged into the officer's lane barely missing the police cruiser.

The officer pulled Montoya over.

He says Montoya claimed to have only had two beers but the officer smelled liquor on him and Montoya had bloodshot eyes.

The affidavit says Montoya didn't pass the sobriety test and refused a breathalyzer.

He was taken in on several charges.
