Clerical Error Causes Case to be Dismissed Against Midland Woman

MIDLAND - A Midland aunt, accused in her nephew's death, had her case automatically dismissed because of a clerical error.

Denise Harper is accused of leaving a four year old boy unattended at a pool last October where he drowned.

His brother found him at the bottom of the pool and pulled him out.

We're told the wrong charge was filed against her.

She was originally charged with injury to a child but she was supposed to be charged with criminally negligent homicide.

We're told Harper will be re-indicted with the correct charge.
