Charges Upgraded Against Father Who Choked His Son

The father who choked his son and left him for dead on the Interstate is back in Sweetwater, facing even tougher charges.

NewsWest 9 has learned 22-year-old Carlos Rico is now being charged with attempted capital murder. That's because his son is under the age of six.

He was taken to the Nolan County Jail on Wednesday night from Saginaw where he turned himself in.

Police say Rico told them he had a divine intervention and god told him to kill his son.

His bond is set at half a million dollars.

Rico's four-year-old son was spotted on Interstate 20 in Sweetwater on Tuesday morning by a local coach.

He found the boy dehydrated and covered in cactus thorns.

Nurses who treated him nicknamed him "Angel."

He's now in the custody of Child Protective Services.

The Nolan County grand jury will take the case up in July.

Until then, Sweetwater police are continuing with their investigation.
