ODESSA - Nearly 40 construction workers were taken into custody Tuesday morning by federal immigration authorities at an apartment complex under construction in Odessa.

Immigration and Customs Enforcement, along with numerous other agencies, executed search warrants just before 8:00 a.m.

Authorities say there were 100 workers at the new Tuscany at Faudree apartments on Faudree near Highway 191. 37 workers were taken into custody.

NewsWest 9 spoke with Marc McDougal, the contractor of the apartment complex, and he said his company hires some employees and they also hire subcontractors. Those subcontractors are allowed to hire their own employees and those were the workers who were arrested.

"It wasn't any of our employees, all of ours were fine. Apparently there were some subcontractors on the job that did not have any paperwork with them or didn't have it. I've been doing these jobs since the early 1980's and it's the first time we've ever had anything like this at one of ours," McDougal said.

ICE, US Marshals, Odessa Police, the Midland County Sheriff's Office, the Ector County Sheriff's Office and the Andrews County Sheriff's Office all took part.

The workers who were taken into custody were loaded onto a white Homeland Security charter bus and taken away from the property. The other workers were allowed to leave.
