MIDLAND - A Midland man sentenced to 60 years in prison for murder had his fourth appeal shot down.

Alex Saldana was convicted back in 2009 for shooting and killing a man in the parking lot of a Whataburger.

You'll remember, the victim, Stephen Adams, was waiting in the parking lot with his wife while his daughter was ordering food inside.

That's when Saldana opened fire, hitting Adams.

Saldana appealed on the grounds of a mistrial saying a detective commented on his clothing, saying it could be associated with a gang.

The court denied Saldana's appeal.
