Man Shot and Killed by Homeowner Defending Property

ODESSA - A man is dead after being shot while allegedly trying to steal equipment from a vehicle in Odessa.

Police say the shooting happened around 4:20 Friday morning near 23rd and Muskingum. A homeowner heard dogs barking and when he looked out his window he saw several people burglarizing his vehicle which had electrical equipment inside.

The homeowner yelled at the subjects and then grabbed a gun and fired at them. The suspects then fled the area.

Police say they then received a 911 call from 6714 Ector about a gunshot victim. By the time paramedics and police arrived the suspect had already died.

Police have released the name of the man shot and killed. He has been identified as 53-year-old Rodney Allen Burns of Odessa.

Police arrested two suspects for attempting to burglarize the vehicle. Tanya Lynn Whitehead and David Allen Whitehead of Odessa were charged with theft of copper wire. Both are now at the Ector County Detention Center.

As for the homeowner, Odessa Police say the much talked about "Castle Law" does not apply in this case, but there is another law that covers people defending their property at night.

Odessa Police say they are still investigating. At this time, no charges have been filed against the homeowner.
