WINKLER COUNTY - An attempt to oust the Winkler County District Attorney out of office is over.
A lawsuit aimed at removing D.A. Michael Fostel has been dropped.
Winkler County Attorney Scott Tidwell filed a motion to dismiss the petition.
That petition was filed by a hospital board member and Kermit resident John Walton.
Walton claimed Fostel hadn't been doing his job.
Fostel has been in and out of the hospital since September of 2009.
He says he's been recovering from several surgeries and was working part time until returning full time, earlier this year.
