NEWS FEED: Dwayne Billings Sentenced to Four Life Sentences

1/19/11, 1:00 p.m.: The jury has sentenced Dwayne Billings to four life sentences.

1/19/11, 12:20 p.m.: The jury has said they cannot reach a sentence. The judge has told them to keep deliberating.

1/18/11, 5:55p.m.: NewsWest 9 has learned that the jury has returned a guilty verdict on all counts that Dwayne Billings was facing. Sentencing is scheduled for 9a.m. Wednesday morning. Billings faces between 5 to 99 years behind bars.

1/18/11, 5:45p.m.: The jury has reached a verdict in the trial of Dwayne Billings. We don't yet know the verdict. Stay tuned here for the latest.

1/18/11, 4:00p.m.: The prosecution and defense have given their final arguments to the jury and now it is up to the four man, eight woman jury to decide on the case against Dwayne Billings. Billings is facing three counts of aggravated sexual assault with a child and one count of aggravated kidnapping. Billings plead not guilty to the charges. The jury does have three options in considering their verdict, they can decide if Billings is guilty or innocent on all counts or they can also return a verdict of not guilty by reason of insanity.

1/18/11, 10:30 a.m.: Court is taking first break of the day. A court appointed psychiatrist testified this morning that he examined Billings in 2008. Doctors says Billings is borderline mentally retarded. A pervious examination in 1998 ruled that out.

1/18/11, 9:15 a.m.: Victor Lopez reports the presentation of evidence should wrap up this morning with closing arguments after lunch.

1/17/11 Update, 7:30p.m.: The trial of Dwayne Billings will resume on Tuesday morning. Defense attorney's plan to call mental health experts to the stand and they're expected to say that Billings is mentally ill. Keep it tuned to this page for the latest updates from Victor Lopez on Tuesday morning.

1/14/11 Update, 12:00p.m.: The Dwayne Billings trial has recessed until Tuesday morning. Billings did take the stand this morning as the defense started laying out their case.

1/13/11 Update, 4:15p.m.: The prosecution has rested their case in the trial of Dwayne Billings. The defense will now present their case to the jury.

1/13/11 Update, 1:00 p.m.: The interrogation video says Billings saying he did not know the girl. He also says that she may have initiated sexual contact because he was asleep and didn't know what was going on. Testimony resumes at 1:45 after lunch.

1/13/11 Update, 10:30 a.m.: Victor Lopez reports that the first witness of the day is David Trujillo, he was the lead investigator on the Billings case. Jurors are now watching a three hour interrogation video from when he was arrested.  

1/12/11 Update, 6:00 p.m.: Dwayne Billings showed little emotion today during the first day of his trial. Numerous witnesses, including his alleged victim, took the stand today. Throughout the victim's testimony, she graphically explained what happened to her. Throughout the day, there was a battle of objections between the defense and prosecution during the direct and cross-examination of witnesses. A total of eight defense witnesses were called to the stand today. Testimony will continue Thursday morning at 9a.m.

1/12/11 Update, 11:00 a.m.: The day started with the alleged victim's grandmother taking the stand talking about the mental disorders the victim, who is now 13, has been diagnosed with. The alleged victim then took the stand with her grandmother staying behind as a calming influence. Victor Lopez reports chilling testimony from the girl, but Billings has shown no emotion. Victim described the sexual assault and says Billings told her that if she told anyone about the assault he would kill her.

1/11/11 Update, 3:00 p.m.: A jury has been seated. Opening arguments will begin first thing Wednesday morning. The jury is made up of four men and eight women. More than 100 potential witnesses have been called to testify including the alleged victim.

1/11/11 Update, 1:40 p.m.: The jury selection process is wrapping up. A finalized jury should be picked soon.

1/11/11 Update, 12:15 p.m.: Potential jurors have been given a short break after being questioned by the Prosecutor Scott Layh. Layh has been asking jurors if they can reach a verdict of guilty beyond a reasonable doubt and put aside anything they may have already heard in the media and just go on the evidence presented. Billings has been sitting in the court, but it is hard to tell how he is reacting to what is going on. The defense will start questioning potential jurors at 12:30.

1/11/11 Update, 11:00 a.m.: A jury is expected to be seated by this afternoon. Judge says the trial will likely last into next week.

1/11/11 Update, 9:00 a.m.: Potential jurors are arriving to the courtroom.

ODESSA - Jury selection has begun in the trial of Dwayne Billings. He's accused of kidnapping and sexually assaulting a 9-year-old girl from West Odessa back in 2007.

The kidnapping set off a city-wide search that included hundreds of residents who turned out to find the little girl.

Billings was ruled competent to stand trial back in October of 2009. NewsWest9's Victor Lopez is in the courtroom providing full updates on the proceedings. Those updates are being posted at the top of this story.
