A technical oversight could lead to legal action against the Texas Low Level Radioactive Waste Disposal Compact Commission.
'Promote Andrews' says the Commission didn't properly receive comments from the public regarding the construction of Waste Control Specialists in Andrews.
The commission voted to adopt new rules that could allow 36 other states to send their radioactive waste to Waste Control Specialists.
They held a 30-day public comment period to hear what folks thought but 'Promote Andrews' says the Commission set up an invalid email address and so comments that were sent were never received.
'Promote Andrews' says they believe the Commission didn't follow their own administrative process in getting those comments and so they plan to file suit.
The Commission has scheduled another meeting for discussion on January 4 in Andrews County.
