After five years, the former West Texas State School principal will see his day in court but it won't be in Ward County.

On Wednesday, John Paul Hernandez's attorney filed the motion for a change of venue.

The trial is now set for early February in Lubbock.

Hernandez is accused of sexually abusing students at the Texas Youth Commission jail in Pyote.

The Texas Rangers started their investigation back in 2005.

Hernandez along with former Assistant Superintendent Ray Brookins were indicted in April of 2007.

Brookins was convicted of two counts of improper relationship between an educator and student and sentenced to ten years behind bars.

The West Texas State School in Pyote has since been shut down by the state.
