Former Midland Soldier Challenging Conviction

LOUISVILLE, Ky. (AP) - A former U.S. soldier who raped a girl, killed her and then murdered three of her relatives is challenging his convictions, saying he should have been tried in a military court.

Attorneys for Steven Dale Green of Midland, Texas, filed a 71-page appeal Monday saying he should not have been charged as a civilian.

They want the law used to prosecute him overturned. The law allows former soldiers, their spouses and contractors to be tried in civilian courts for crimes that happened overseas.

A message left for the U.S. Attorney's Office in Louisville was not immediately returned Monday.

A jury convicted the 24-year-old Green in June of raping and killing 14-year-old Abeer Qassim al-Janabi and killing three of her family members in March 2006. He is serving life in prison.
