MIDLAND – A late night, high-speed chase, could send a driver to jail when he gets out of the hospital.

Midland County Sheriff Gary Painter says it all started around 1:30 on Tuesday morning.

A Deputy tried to pull over a car on Highway 191, but the driver, Toribio Rodriguez sped up and took off.

Rodriguez finally crashed and rolled when he hit a guardrail.

He was going about 100 miles an hour on Loop 250, near Highway 80.

A passenger was thrown out through the back glass, and is still in the Intensive Care Unit at Midland Memorial Hospital.

Rodriguez was also taken to the hospital.

Deputies say he'll likely face intoxication assault and felony evading charges.
