A former Midland Lee basketball coach is a free man in New Mexico.

Dan Simmons was acquitted on 35 counts of sexual misconduct.

A Bernalillo County Jury made that decision last Friday.

Simmons was accused of having sex with a former female player, while he was a coach at Rio Grande High School in Albuquerque from 1994 to 1998.

Simmons also was found not guilty in 2007 of indecency with a child in Midland.

That's after a Lee High School player says Simmons had touched her inappropriately in his office in 2002.

Simmons isn't out of hot water just yet.

He faces similar charges in Lubbock, also filed by a former basketball player.
