Midland Officer No Billed by Grand Jury

MIDLAND - A Midland Police officer is back on duty after being no billed by the Midland County Grand Jury.

29-year-old Joey Garcia was no billed in the shooting death of a man outside The Ranch on North Big Spring last month. Officer Garcia returned to the force Friday after being on administrative leave.

The shooting happened around 1:00 a.m. July 11th. Garcia was working off-duty when a fight broke out at the bar.

27-year-old Jermey Waller was asked to leave, but soon returned and attacked Garcia while being arrested.

Waller threw Garcia to the ground and hit the officer with the handle of a knife. Garcia was able to knock the knife out of Waller's hand, but Waller was able to get the knife again and started moving aggressively toward the officer. That is when Garcia fired two shots at Waller. Waller died at Midland Memorial Hospital.
